Although it is Virginia public policy to promote marriage, like most states Virginia has “no-fault” divorce. That does not mean that issues of fault, such as cruelty, adultery, abandonment or desertion, will not be a factor in the court’s decision to grant a divorce and award support. These issues can influence and do influence the court’s decisions, no matter how the marital dissolution is labeled.

One of the ways in which Virginia promotes marriage is by requiring couples to observe a period of legal separation before they can file for a no-fault divorce. Legal separation, in addition to a residency requirement, are both necessary if you wish to receive a divorce in Virginia.
